1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Mountain Veteran Program website located at mvpsundance.org (the "Site") and your participation in any MVP programs. By accessing the Site or submitting an application, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. About Mountain Veteran Program
Mountain Veteran Program ("MVP") is a nonprofit organization based at 8841 N. Alpine Loop Road, Sundance, UT 84604. MVP provides cost-free, outdoor therapeutic experiences for wounded veterans and their guests in partnership with Sundance Mountain Resort in Sundance, Utah.
3. Program Eligibility
Participation in MVP programs is subject to the following eligibility requirements:
- Applicant must be a wounded veteran with a service-connected injury, wound, or disability
- Applicant must be able to participate in a group setting
- Applicant must commit to attending the full duration of the program
- Applicant must provide valid documentation verifying military service and service-connected injury or disability
MVP reserves the right to determine eligibility at its sole discretion and to decline any application.
4. Application Process
Submitting an application does not guarantee acceptance into an MVP program. Applications are reviewed by MVP staff, and acceptance is communicated by email. MVP reserves the right to limit program capacity and to prioritize applicants based on need, availability, and program fit.
You agree to provide accurate, complete, and truthful information in your application. Providing false or misleading information may result in disqualification or removal from a program.
5. Cancellation Policy
If you need to cancel your participation in an MVP program, please notify us as soon as possible by emailing us at info@mountainveteranprogram.org.
If you cancel less than seven (7) days before your scheduled program date, or if you are a no-show without prior notice, you will not be eligible to participate in another MVP program for a period of two (2) years from the date of the missed program. Extenuating circumstances will be reviewed on a case-by-case basis at MVP's sole discretion.
6. Service Dog Policy
Participants who intend to bring a trained and certified service dog must indicate this in their application. MVP will provide a Service Dog Policy document to applicants who indicate they will be traveling with a service dog. Participants are responsible for reviewing and complying with that policy, as well as all service animal policies of Sundance Mountain Resort.
7. Assumption of Risk
MVP programs include outdoor and adventure activities such as skiing, snowboarding, snowshoeing, white-water rafting, horseback riding, zip lining, fly fishing, hiking, and yoga. These activities involve inherent risks of physical injury. By submitting an application and participating in an MVP program, you acknowledge these risks and agree that MVP, its staff, volunteers, and partners are not liable for injury, illness, loss, or damage arising from your participation, except in cases of gross negligence or willful misconduct.
8. Donations
All donations made through the Site are voluntary and are used to support MVP's programs and operations. MVP is organized as a nonprofit organization.
MVP does not currently maintain a formal refund policy for donations. If you believe a donation was made in error, please contact us at info@mountainveteranprogram.org and we will review your request on a case-by-case basis.
9. Intellectual Property
All content on the Site, including text, images, logos, and program descriptions, is the property of Mountain Veteran Program or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any Site content without prior written permission from MVP.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
11. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. MVP does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, Mountain Veteran Program shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in MVP programs.
13. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Utah County, Utah.
14. Changes to These Terms
MVP reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
